1. Introduction

Upland Knives, LLC gathers certain types of information about the visitors to our websites and those visitors who use its services, and we believe our visitors should fully understand how we obtain and use that information. This Privacy Statement discloses what information we gather and how we use it. By using our websites and services (collectively, the “Services”), you acknowledge you have read and understood the terms and conditions of this Privacy Statement. If you do not agree with the privacy practices described in this Privacy Statement, you may not use the Services.

2. Your Security

As we all know, the internet can be a dangerous place for everyone's personal information. We retain PI only for as long as needed to achieve the purpose for which it was collected.

3. Collection of PI

The submission by you to Upland Knives, LLC  of PI may be required in order for you to receive certain services, products or information you request from uplandknives.com..

We collect the following categories of PI:

  • Identifiers, such as your name, address, email address, and IP address.

  • Customer records information, such as your name, address, telephone number, and payment type information (no card numbers).

  • Commercial information, such as products or services purchased, obtained or considered,  and other purchasing or consuming histories.

  • Internet or other electronic network activity information, such as your operating system, browser ID, and information regarding your interaction with our website.

  • Communications, if you contact us.

4. Cookies and Tracking Technologies

We, and our third-party partners, may use cookies and similar tracking technologies such as pixels and web beacons, to collect and use PI about you and to gather information about your activities when using our services or visiting our websites in order to provide you with a personalized experience and offers based on your browsing activities and interests. We may collect this information as a part of log files as well as through the use of cookies or other tracking technologies. Specifically, the information we collect automatically may include your IP address, your operating system, your browser ID, your browsing activity, your email interconnectivity, and your location data, and other information about your system and connection and how you interact with our websites and third-party websites, such as Google. You can choose to allow our websites to collect and use real-time information about your location through the device’s privacy settings. 5. Public Information and Third-Party Websites

We may collect information from publicly available sources or through third-party websites.

  • Social media platforms and widgets. Our websites may include social media features, such as the Facebook Like button. These features may collect information about your IP address and which page you are visiting on our websites, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our websites. We maintain a presence on multiple social media platforms, including Facebook, Twitter, and Instagram. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

  • Aggregate data providers. Our company utilizes third party aggregate data providers that collect publicly available information. This information can then be used to validate identity, addresses, and other information used in our business processes.

  • Links to third-party websites. Our websites include links to other websites, whose privacy practices may be different from ours. If you submit PI to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any websites you visit.

  • Contests and sweepstakes. We may, from time to time, offer surveys, contests, sweepstakes, or other promotions on our websites or through social media (collectively, “Promotions”). Participation in our Promotions is completely voluntary. Information requested for entry may include PI. A Promotion may be held under a privacy policy or terms and conditions that are in addition to or separate from this Privacy Statement. If the terms of the Promotion’s privacy policy or terms of use conflicts with this Privacy Statement, those additional or separate provisions will prevail. We use the information you provide to administer our Promotions. We may also, unless prohibited by the Promotion’s rules or law, use the information provided to communicate with you, or other people you select, about our products and services. We may share this information with our affiliates and other organizations or service providers in line with this Privacy Statement and the rules posted for our Promotions.

6. Use of PI

We may use the information we collect through our marketing, services, and websites for business and reporting purposes, including:

  • To assist with verifying your identity, in an effort to prevent fraud and identity theft.

The information we collect can be combined, segregated, and stored with safeguards in place to protect all applicable to PI, respectively. We do not “sell” your PI, as that term is defined by the California Consumer Privacy Act (CCPA).

7. Legal Bases for Processing

We process PI using the following legal bases:

  • Where use of your information is necessary to perform our obligations under a contract with you (for example, to comply with the terms and conditions of our websites which you accept by browsing the websites/registering, and/or our contract to provide our Services to you);

  • Where use of your information is necessary for our legitimate interests (for example, to provide security for our Services; operate our business and our Services; to make and receive payments; to comply with legal requirements and defend our legal rights; and to prevent fraud);

  • Where we have your consent, in accordance with applicable legal requirements, to use your information for a particular purpose (which consent you may withdraw at any time by contacting us); or

  • Where we use your information to comply with applicable legal obligations (for example, keeping track of purchases for tax and auditing purposes).

8. Testimonial/Reviews about Products

By posting your testimonial/reviews, you give us permission to reprint or use the testimonial/reviews in connection with our business. You also are agreeing to the following:

  1. The reprint or use of the testimonial/reviews will be at our discretion and without compensation;

  2. We may use the testimonial/reviews with or without any pseudo (pen) name credit;

  3. Our right to use the testimonial/reviews is perpetual and may be assigned by us;

  4. We may use the testimonial/reviews locally, nationally or globally and such use may be made in any media, information or communication platform (including Internet advertising) currently in use or later developed; and

  5. You and not someone else composed and posted the testimonial/reviews.

Please note that any information you include in a testimonial/reviews may be read, collected, and used by anyone. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN TESTIMONIALS/REVIEWS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN TESTIMONIALS/REVIEWS.

9. Sharing and Disclosure of PI

We may share or disclose your PI to the following categories of third parties and for the following reasons:

  • To third party service providers, agents or independent contractors who help us maintain our Services and provide other administrative services to us.

  • We may share your personal information in the course of any reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.

  • We may disclose your personal information to law enforcement, government agencies, and other related third parties, in order to comply with the law, enforce our policies, or protect our or others’ rights, property or safety.

While we may share your PI with third parties, we do not “sell” your PI.

10. Protecting children's privacy

We are committed to protecting children's privacy on the internet and we do not knowingly collect PI from children under the age of 13 in the U.S. or 16 in the EU or United Kingdom. If you are under the age of 13 in the U.S. or 16 in the EU or United Kingdom, do not use our websites or provide any PI to us. If we learn we have collected or received PI from a child under 13 in the U.S. or 16 in the EU or United Kingdom without verification of parental consent, we will delete that information in accordance with applicable law. If you believe we may have any information about a child under 13 in the U.S. or 16 in the EU or United Kingdom, please contact us.

11. Electronic Newsletters

Uplandknives.com offers free electronic newsletters that are dispatched by an email service provider (ESP). We collect email addresses of individuals who voluntarily subscribe, create accounts, participate in promotions, and purchase products on our websites. Individuals may subscribe, update their profile, or unsubscribe from one or more of our mailing lists at any time online, by clicking the link in the footer of our promotional emails.

In certain locations on our websites in which we obtain PI from you, we may include “check boxes” for the purpose of soliciting your consent to receive special offers and other information from uplandknives.com. If given your consent, you may receive promotional information from us by email, U.S. mail or other means. You will have the opportunity at any time to “opt-out” of receiving future commercial emails from Uplandknives.com either by following the instructions located at the bottom of the email we send you.

Uplandknives.com delivers newsletters, and marketing and product offerings promoted in newsletters, by email only to registered recipients. We do not purchase 3rd party email lists.

12. International Data Transfers

We are based in the U.S. If you choose to provide us with information, please understand that your PI may be transferred to the U.S. and that we may transfer that information to our affiliates or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the EU or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your PI to the U.S. and other jurisdictions which may not have the same data protection laws as the EU. We put in place appropriate operational, procedural and technical measures in order to ensure the protection of your PI. You acknowledge you understand that by providing your PI: (i) your PI will be used for the uses identified above in accordance with this Privacy Statement; and (ii) your PI may be transferred to the U.S. and other jurisdictions as indicated above, in accordance with applicable law.

13. Changes to this Privacy Statement

Uplandknives.com reserves the right to change this Privacy Statement at any time. When we do, we will also revise the “Last Updated” date above. If we make material changes to the Privacy Statement, we will notify you more directly, such as by placing a prominent notice on our website or via email at the email address we have on file for you. Please check this page periodically for changes. Your continued use of this website following the posting of changes to these terms will mean you accept those changes. Information collected prior to the time any change is posted will be used according to the rules and laws that applied at the time the information was collected.

14. California Privacy Rights

The CCPA provides California residents with the following rights related to their PI:

  • Right to Know – The right to request that we disclose certain information about our collection and use of PI over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you the categories and specific pieces of PI we have collected about you, as well as the categories of sources from which such data is collected, the purpose for collecting such data, the categories of third parties with whom we share such data, and information about our sale or disclosure for business purposes of your PI to third parties. Much of this information is provided above in this Privacy Statement.

  • Right to Delete – The right to request that we delete any of the PI that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your PI from our records, unless an exception applies.

  • Right to Opt-Out of Sale – The right to opt-out of the sale of your PI to third parties. Note, we do not “sell” PI, as that term is defined by the CCPA.

  • Right to Non-Discrimination – The right to not be discriminated against for exercising any of these rights.

If you would like to exercise one or more of the above rights, please contact us by phone or contact form using the contact information below. We may need you to provide additional information to verify your request, such as providing certain data elements so that we can confirm they match the PI already maintained by us. We will not use this additional information for anything other than handling your request. You may designate an authorized agent to make a request in certain circumstances on your behalf. Such authorized agent must be registered with the California Secretary of State. We will endeavor to respond to all such requests within forty-five (45) days, although there may be a brief delay in processing a request while we verify that the request is valid and originates from you as opposed to an unauthorized third party. If we require more time, we will inform you of the reason and extension period in writing.

Notice of Financial Incentive. We may provide price discounts, coupons, services and other perks for members of our loyalty program. There is no obligation to opt-in and consumers may opt-out at any time. We offer this program to enhance our relationship with you so you can enjoy more of our products/services at a lower price. The value to our business of any individual consumer’s data is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any offerings, and whether and to what extent you opt out of any offerings.

Shine the Light. Where applicable, California Civil Code Section 1798.83 permits users of the websites that are California residents to request certain information regarding our disclosure of PI to third parties for their direct marketing purposes. To make such a request please contact us.

15. GDPR Rights

If you are a data subject in the EU, you have the following rights under the General Data Protection Regulation (“GDPR”):

  • The right to be informed about our collection and use of PI;

  • The right of access to the PI we hold about you;

  • The right to rectification if any PI we hold about you is inaccurate or incomplete;

  • The right to be forgotten – i.e., the right to ask us to delete any PI we hold about you;

  • The right to restrict (i.e., prevent) the processing of your PI;

  • The right to data portability (obtaining a copy of your PI to re-use with another service or organization);

  • The right to object to us using your PI for particular purposes; and

  • Rights with respect to automated decision making and profiling.

If you have any cause for complaint about our use of your PI, please contact us using the contact information provided below, and we will do our best to solve the problem for you. If we are unable to help, you also have the right to lodge a complaint with the supervisory authority in your country.

16. Nevada Residents

Nevada law gives Nevada consumers the right to request that a company not sell their PI for monetary consideration to certain other parties.  This right applies even if their PI is not currently being sold.  If you are a Nevada consumer and wish to exercise this right, please send an email with the subject line “Nevada Resident Do Not Sell Request” to info@uplandknives.com.

17. How We Respond to Do Not Track Signals

At this time, our website does not recognize automated browser signals regarding tracking mechanisms, which may include Do Not Track instructions.

18. Your Consent

BY ACCEPTING OUR PRIVACY POLICY, YOU EXPRESSLY AUTHORIZE US TO USE THE INFORMATION YOU PROVIDE WITH OUR SERVICE PROVIDERS, WHICH MAY BE LOCATED OUTSIDE OF YOUR COUNTRY OF RESIDENCE, EVEN IF SUCH INFORMATION IS COVERED BY LOCAL BANKING LAWS AND TO THE EXTENT PERMITTED BY LAW, YOU EXPRESSLY WAIVE YOUR RIGHTS UNDER SUCH BANKING LAWS WITH REGARD TO US AND ANY OF OUR TRUSTED BUSINESS PARTNERS AND SERVICE PROVIDERS. YOU ACKNOWLEDGE AND AGREE THAT THE SHARING OF SUCH INFORMATION IS NECESSARY TO PROVIDE THE SERVICE AND THIS CONSENT IS GIVEN FOR THE DURATION OF YOUR RELATIONSHIP WITH US.
